Introduction

Introduction

The Core Standards for guardians of separated children in Europe aim to provide a guardianship instrument to all European countries, irrespective of the different guardianship systems in each country.  
The important role of the guardian in the life of a separated child is reflected in several EU directives. However, a definition of what a guardian is or should do is lacking. By interpreting the current EU instruments in line with the Core Standards for guardians the quality of guardianship systems all over Europe and within countries can harmonize and protection gaps for separated children can be closed. This interpretative guidance aims to inspire State Authorities to give concrete meaning to the role of the guardian in the transposition and implementation of the EU directives.


Core Standards CONNECTED

For this interpretative guidance a connection is made between the Core Standards for guardians of separated children in Europe and the EU Reference tool that was developed in the CONNECT project (see for more information: www.connectproject.eu). The EU Reference tool as developed in the CONNECT project sets out the body of EU law and policy which relates to unaccompanied children. In the EU reference tool, the EU provisions on unaccompanied minors are linked with rights in the UN Convention on the rights of the Child in order to facilitate their implementation, application and interpretation in line with the UN CRC, as required under EU law. As the EU Commissioner for Home Affairs, Cecilia Malmström stated in her foreword in the CONNECT reference tool ‘we have so far succeeded in setting the legal framework. Now is the time to focus on implementation, to make sure this progress really brings about changes to children’s lives. The Closing a protection gap 2.0 project takes the excellent EU Reference tool from the CONNECT project as a starting point and links this information to the Core Standards for guardians of separated children.


In the overview table a link is made between key EU provisions on unaccompanied minors and the corresponding Core Standards for guardians of separated children in Europe. The interpretative guidance for the implementation of the key EU provisions in line with the Core Standards for guardians is provided in the detailed table. This interpretative guidance is the sole responsibility of the Closing a protection gap project partners and can in no way reflect the views of the European Commission or the CONNECT project partners.
